Profession Tax Registration- Professional Tax is governed through the Professional Tax Act and it is levied by the respective state government. It is levied on every working professional like chartered accountants (CA), Company Secretaries (CS) Advocates, doctors and other even freelancers are also included. It is levied in accordance with the individual’s employment or trade & profession. The rate of Tax is different in different states however, the maximum amount which can be recovered by state government shall not exceed Rs.2,500 per annum. This means that the maximum amount of Tax that is chargeable is limited to Rs.2,500.

West Bengal, Karnataka, Kerala, Maharashtra, Madhya Pradesh, Assam, Tripura, Orissa, Meghalaya, and Gujarat are the government that levies and collect Professional Tax. In 2018, the state government of Maharastra made it mandatory for Limited Liability Partnership (“LLP”) and also the partner of LLP to be a professional Tax of Rs. 2,500/- per annum. Here the person who may be earning wages or salary does not matter whether he is government or non-got. Employees are also covered under the Professional Tax Act and the liability for payment and collection of professional Tax at a rate as prescribed under the Act is on the employer only

The business constitution can be 

  • Any Sole Proprietor
  • Any Partnership Firm whether registered or not 
  • Private Limited Company or Public Limited Company
  • Limited Liability Partnership (LLP)
  • Any society, Trust or association of person 
  • Hindu Undivided Family (HUF)

Following are the document required to take registration for Professional Tax

  1. A signed copy of PAN card of Assessee
  2. A signed copy of Aadhaar card
  3. Passport size photographs 
  4. Cancelled cheque
  5. Information about Business
  6. No. of employee in the premises 
  7. Electricity bill as a proof of business premises
  8. Date of Commencement of business
  9. Email ID and Mobile no of the Assessee
  10. COI MOA& AOA in case of company 
  11. POA

Exemptions under Professional Tax Act

Following are the person who are exempted from payment of professional Tax 

  • Any Person who has completed an age of 65 years; 
  • Female employees earning salary or wages up to Rs 10,000 pm or 15,000/- (in a certain state) are exempted ;
  • Mahila Pradhan Kshetriya Bachat Yojana (women engaged as Agents).
  • Armed forces of Union
  • In the textile industry Badli workers.
  • Person suffering from permanent disability
  • Professional having standing upto 1 year

Once the application is being filed with respective jurisdictions alongwith the documents as mentioned above and is complete in all respect the scrutiny shall be done by proper officer and thereafter a communication is send if he required anyother document or information, once the office is satisfied with the submission he will issued the certificate and shall communicate to the applicant.

It is to be noted that in case the application of the applicant is found to be defective a memorandum of deficiency shall be issued, thereafter the applicant shall remove the same and submit the document with the concerned officer and is the officer is satisfied then the certificate will be issued. However if no communication is received by officer from applicant then he shall reject the application. Profession Tax Registration
